Lawyer's bid to rescue puppy results in his death

Kota Kinabalu: A 27-year-old lawyer who went out of his way to help a puppy in distress fell headlong into the hole it was trapped in and died early Wednesday. Jay Jeffrey Linjungan's father who returned to the family home in Kg Ramayah, Penampang around 11am, found him stuck in the three-metre deep hole nearby.
"His father saw his vehicle still parked in the garage, prompting him to search for Jay, only to find his son's legs jutting out with his body halfway out of the hole," said his close lawyer friend, who only wished to be identified as Adel.
It was said that he was still breathing when his father found him, but was pronounced dead upon arrival at the hospital where doctors found mud stuck in his mouth.
Adel said Jay who loved animals is believed to have tried to save the puppy but slipped and fell into the hole which was covered in mud.
It was learnt that heavy rain the previous night had caused a landslide in the area.
Sabah Law Association President Datuk Ganesh Nandy described Jay's untimely demise as a loss to the Sabah Bar, saying Jay was one of the promising young lawyers.
"I knew him when he was still chambering with a firm because our respective companies were in the same building at Wisma Merdeka," he said.
"If I am not mistaken Jay was admitted to the Sabah Bar about one and a half years ago. I can remember it because I presided on behalf of the SLA at that time and I also interviewed him," said Ganesh.
"Actually I met him in the court Tuesday morning. As usual, he was doing his work, normal things, and greeted everyone and talking with his friends," recalled Ganesh.
Others who also knew Jay, who read law at UiTM after finishing his secondary studies at St Michael's Penampang, also described him as an affable young man who got along well with others.
His childhood friend, known only as Ryne, 28, claimed the last time they met was during a full moon celebration of their friend's child.
"I tried contacting him since last night via WhatsApp and calls but he did not answer me," he said, adding he tried calling again today (Wednesday) only to be told about the incident.
Ryne described him as a responsible man who was the hope of the family.
Penampang MP Darrel Leiking who also knew him said he was heartbroken on hearing the sad news.
"He was a good boy until the end É this is not something that we do everyday," he said. Animal activist Sam Lau when contacted said it is most unfortunate that a person should die in such a manner.
"Even though I have never met him in person, I have utmost respect for what he did. It is a noble act for a person to take the time and risk their life to rescue an animal," said Lau. Police have classified the case as sudden death.

KOTA KINABALU: The number of complaints on stray animals received by Kota Kinabalu City Hall (DBKK) decreased by 44 cases last year.
Assistant Minister to the Chief Minister, Datuk Edward Yong Oui Fah, said this yesterday before flagging off the ‘Walk For Animals’ 2014 charity walk co-organized by DBKK and the Society for Prevention of Cruelty to Animals, Kota Kinabalu (SPCAKK).
“The total number of complaints received in 2013 was 247 cases, compared to 291 cases that City Hall received in 2012,” he said.
Yong added that City Hall had been collaborating with the SPCAKK in the ‘Trap, Neuter and Release’ programme which is intended to neuter and spay stray animals, before releasing them into the streets as a preventive method to curb the proliferation of more strays.
“To date, the joint effort between SPCAKK and City Hall has seen the neutering of 32 dogs in the Tanjung Aru area and 28 dogs in other industrial and commercial areas,” he said.
Meanwhile, Yong said that ensuring the city is free from stray animals is one of the measures to maintain the safety and orderliness of a city.
Also present at the event was DBKK director-general Datuk Yeo Boon Hai.
Animal lovers from all walks of life gathered for the three-kilometre charity walk to support and raise awareness on animal welfare here yesterday at Tanjung Aru First Beach.
The charity walk was also aimed at raising funds for a project to relocate the current SPCAKK adoption centre, which has been severely affected by flash floods and mudslides.
“Relocating our animals to a dryer and safer place is now our urgent focus,” said SPCAKK’s eead of education, Dr Roslee Abbas, on behalf for its president, Henny Liew.
Faridah Malai, a lifetime SPCAKK member, lauded the efforts by the SPCA to educate the public on animal welfare through the charity walk.
“A lot of us still do not understand that animals are a lot like humans. It’s really important to show compassion to animals and I think this would reflect the goodness of our country,” she said.
Faridah feeds and houses about 50 stray cats and dogs on her own accord and expenses while owning four cats of her own.
“There are a lot of strays on the streets but I believe a way to solve this is through the trap and neuter program,” she said, adding that it is one of the ways to prevent more strays.
Meanwhile, another SPCAKK member, Ong En Oi, also joined the walk to support the cause with her sister, Nurmina Nawali and other family members.
Ong houses 17 cats, some of which are adopted and from people who have decided that they did not want them as pets anymore.
She said the cats, which she has kept since 2001, are kept in a separate house which she has built behind her residence.
Nurmina affectionately said that cats around the housing area seemed to know that her sister’s home is a refuge, while supporting her (Ong’s) efforts to spay and neuter all her cats.
Others such as Azizah Yusop, while not having pets of her own, still believes that the charity walk can help raise public awareness on animal rights issues.
Rozah Mahmud, meanwhile, hopes that increased education and awareness will help others develop empathy towards animals.

60 dogs in KK neutered to get rid of strays

Kota Kinabalu: The joint effort between the Society For The Prevention Of Cruelty To Animals Kota Kinabalu (SPCAKK) and City Hall led to the neutering of 32 dogs in Tanjung Aru and 28 dogs in other industrial and commercial areas, said Assistant Minister in the Chief Minister's Department, Datuk Edward Yong Oui Fah. "I commend the close co-operation between City Hall and SPCAKK for such an achievement," said Yong while officiating the Walk for Animals event at Tanjung Aru First Beach, here.
"Congratulations to SPCAKK and City Hall for organising this walk to mark the start of SPCAKK's public fund raising activities. City Hall has been providing very strong and effective support to SPCAKK programmes such as the TNR (Trap, Neuter and Release) programme."
In relation to this, he said that there is a decrease of 44 cases or 15 per cent of complaints on stray animals which is a good indicator that the stray animal problems are being taken care of by City Hall and SPCAKK.
He said City Hall received 247 complaints on stray animals last year and 291 cases in 2012.
He said in order for City Hall to maintain the safety and orderliness of a city, it does not necessarily mean having to deal only with the problem of people throwing rubbish, but also ensured that the city is free from stray animals.
Yong said it was imperative that City Hall maintain an orderly, safe and clean city in order to give a positive impression to tourists.
Yong also highlighted on the various stories pertaining to animal cruelty.
"They are counting on compassionate people like all of us.
It is heartbreaking as well as infuriating to know the extent of the abuse the animals have to suffer in the hands of human beings.
"And it is up to all of us to give these animals a voice by being their heroes."
This, according to Yong can be achieved by learning about the issues these animals are facing and taking the necessary action to help them.
"Each of us have the power to save these animals from being mistreated and to ensure that they have a proper home," reminded Yong.
He said among the urgent concerns is the relocation of the adoption centre in Lomunu which has been constantly experiencing flash floods and landslide, making it unsafe for the animals and the staff.
Yong pointed out that the fundraising effort was to finance the new centre and its day to day operation.
In relation to this, he urged members of the public to support SPCAKK as they are raising awareness in responsible pet ownership and cruelty to animals. They are also promoting kindness and respect to all animals and in particular, free them from sufferings, abuses and exploitations.
Margaret Tong, an SPCA member since 2006, said she felt very appreciative of participants who joined in the walk.
She hoped that more SPCA branches would be opened in the State.
"So far, there are only two - in KK and Sandakan. Apart from the registered societies, there are also individuals who are doing a lot on their ownÉthere are many unsung heroes out there."
Tina Lu Ting Chih, one of SPCAKK's staff who used to study in Japan, said that based on her observations in Japan, she saw no stray dogs in the streets.
Among those present at the event were City Hall's Director General Datuk Yeo Boon Hai, President of SPCAKK Henny Liew, and SPCAKK's Head of Education Dr. Rosleey Abbas.

25. My dogs are safe

dogs superbly in the second magistrate hearing.

Joshua Kong was today 9-4-14 discharged and acquitted from the charge for keeping “unlicensed” dogs in the house compound since 23-7-13 in the magistrate court on 26-3-14 at the dbkk’s office at 7^th Fl of Centre Point based on public complaints.     The mayor’s application for the destruction of my dogs was also dismissed by the same magistrate at the same sitting.

24. CRIMINAL CONSPIRACY at its worst

The DAY after the first Magistrate Court case by DBKK against my friendly dogs

1.      A DBKK vehicle came to my house at about 10am and two men came to my gate to tell me that they wanted to take photographs of my dogs.

1 Q.  Why take photographs only after I was charges?  Wasn’t proper investigation done prior to filing of documents in the Magistrate Court?  If no proper investigation done, then taking photographs can be the following:-

1Q1.  Contempt of Court and injustice

1Q2.  Invasion of privacy taking photo without Court Order – both front and back.

1Q3.  Intrusion without notice and what happened if I was not home.

1Q4.  The lorry to capture my dogs possibly for evidence could have happened as the lorry could be in the main road as it was before.  Anything could have happened if I was not home.

1Q5.  It was pre-arranged with my neighbour at house no. 26 as the son-in-law allowed the DBKK man in as per photo No. 1 at the back of that house to take photograph of my dogs at the back?   Allowing the DBKK man into the house was an aiding and abetting a serious crime in the context of CRIMINAL CONSPIRACY of SSY and YB Edward Yong in the same gang.  DBKK man could have taken my photo of the dogs if there was a Court Order to do so and enter my house alone.  This also prove that my neighbour at house 26 was wholly behind this CRIME against me and used the two proxies namely Puan Mariana and Pn Susie SOH – and not by chance any more.

DBKK – two officers Willman B. Mihon and Weldie Majinki in the Dogs control unit came to my house about 10am on 27 March, 2014 and one of the officers took photographs of my dogs – 2 in the front portion and 2 in the back portion.  This happened after I was charged in the Magistrate Court on 26^th March 2014 for keeping “6” dogs in my house in July, 2014 based on two “complainants”  who are unknown to me but I believe my neighbour at house 26 is the main complainant using those two dubious complainants as these two complainants were not in the Court to be witnesses, and yet DBKK wanted to convict me without a proper trial.

So the next question is why take photographs now and to prepare the complete affidavits and WHO are persons to sign the AFFIDAVITS with incorrect information as per documents already in Mayor’s documents?  Isn’t it DBKK acting on duress of the YB Edward Yong and the neighbour who is related to him?  So I am to pursue the case to the MACC already brought to its notice.  I think DBKK man only managed to take photographs of 3 dogs with one hiding behind the bushes when Court Document stated 6 dogs.  When we saw Mr Mohd Yaman recently in his office before the Court case commenced, he was telling myself and wife that we can rear as many dogs as possible.  Yet he filed the Court papers with a great discrepancy.

1.     I live at House No. XXX, Lorong XXX, Taman Sri Kepayan, 88300 Kota Kinabalu together  with my wife.

2.     I have no children.

3.     I am elderly and my age is 65 and wife is 69.

4.     We do not deny that we have been rearing dogs within our house compound.

5.     On 29^th of  July, 2013, it was the first time DBKK people came over to the front gate of my house and two persons came forward to the gate.

6.     My dogs are very quiet and dogs being dogs when strangers approach the house, they did whatever other dogs would do.  My dogs naturally bark to notify me and my wife of the strangers.  The dogs being very sensitive to the environment would also bark against alien people including the Indon maid in the next house with extra extension to the partition fence doing her chores so near the partition fence and also walking so near the partition fence in addition to that the Indon maid would aggravate the tense situation by threatening my dogs with waste water thrown at them etc and the right neighbours also asked their friends and relative to come to their house walking up and down the edge of their house so near ours and also the dogs would howl at strange hours at night when they sense demonic charge in the air.  All these noises from the dogs can be accepted and tolerated as the benefits of the presence of dogs in the neighbourhood would sort of bring security alertness all the time.

7.     On that date 29^th of July, 2013, I have a total of 6 dogs.

8.     My dogs never disturb anyone or anything as alleged that any action be taken against them.

9.      Nobody was bitten or hurt.

10. No properties were damaged.

11.  No one lost their hearing or their sleep as a result of the dog barking.

12.  I keep my dogs in complete good hygiene because if the hygiene was poor, my dogs would have died.

13. It is only natural for dogs to shit and urinate just like humans.  It is part of the natural process.

14.  I would be worried instead if my dogs do not shit and urinate.

15.  I had always kept my dogs within the compound and only one occasion when the dogs managed to leave the premises only for limited few minutes due to the contractor poor workmanship of the second internal partition gate.  I called them back and they came back obediently within minutes.

16. The offer of compound is wrong and I should not have been compounded.

17. I have now licenced the dogs and working as a freelance person and no fixed source of income and do not have any pension to fall back on.  My dogs also partly depend on charity for their daily bread.

18. In the premises above, the application to destroy my dogs should be dismissed.

19. It would be cruelty to animals if the animals are shot and killed just because they bark.

20.  Why am I the only victim when there are so many households that keep so many dogs, cats and other animals like rabbit and poultry.

21. Does it mean that the wild animals apart from dogs as pets should all be killed by enforcement even the by-laws do provide for that and such by-laws were very poor in consideration for the well being of society.  Many more serious crimes committed by human beings do not face immediate destruction or capital punishment.  Recently two men were jailed for two years for causing death to Orang Utan in East Coast of Sabah.  So what would be the equitable treatment for human beings desiring the death of my dogs in the same vein of the dead Orang utan?

22. Complainants are not my neighbours as they have not responded to my circulars twice since 25^th of December, 2013 with an enclosed copy and the two complainants namely Puan Mariana and Puan Susie Soh have not responded to my text messages and no statements based on the incomplete complaint forms are available for this case to go to the Courts.

23.   One of the two complainants (both forms incomplete) by the name of Pn Susie Soh possibly linked to Soh See Yee – a criminal at large of several Police Reports - is just another closer indication of the Criminal conspiracy against me via the excuse of my dogs.  A Police Report is enclosed.

24. There are two valid Dogs Ordinance 1960 (Sabah No. 24 of 1996) and Kota Kinabalu Municipal Council (Registration and Control of Dogs) by-laws, 1963 have been observed with variances and inconsistencies.  So which one should be applied ?

25.  Despite several actions by DBKK to take my dogs by force which did not happen and DBKK could not reply to my letter of 17^th of January, 2014 over two important visits by the Minister in charge of DBKK and senior DBKK officers on 26^th of September, 2013 and 24^th of December, 2014 respectively.

26. The Application of the Mayor in the Magistrate Court with the Affidavit in Support of the Application to destroy my dogs are not in compliance of the Enactment No. 15 of 1996 in clause 5 (3) without the Seal of the Mayor attached thereon.  Also the Mayor had acted under unreasonable demands and instigation of others.
